US Patent

A Patent is a right given by the US government to exclude others from making, selling, or using a new invention in the US.

Utility Patent

A utility patent applies to an invention that is a useful process, machine, article of manufacture, or composition of matter.

Design Patent

A Design Patent applies to an invention that is an ornamental design for an article of manufacture.

This process involves searching for prior similar inventions, and making sure that the application was filed within the statutory deadlines. Assignments can be made to change the owner of a patent. Assignments can be recorded with the PTO with the appropriate form and proof of the assignment.

Patent fees are the fees required by the USPTO to process a patent application. The fees can vary depending on the type of application, the number of claims, the type of claims, and the size of the entity applying for the patent. Small entities are often entitled to fees reduced by 50%.
